This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using Mercando's document management and due diligence platform ("Service"). By using the Service, you agree to comply with this policy. Violation of this policy may result in suspension or termination of your access.

1. Prohibited Content

You may not upload, store, or share content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or malicious code
  • Is fraudulent, deceptive, or misleading
  • Contains illegal or controlled substances information
  • Promotes violence, terrorism, or illegal activities
  • Contains child sexual abuse material (CSAM)
  • Constitutes harassment, hate speech, or discrimination

2. Prohibited Activities

You may not:

  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape, crawl, or extract data
  • Circumvent security measures or access controls
  • Impersonate another user or organization
  • Use the Service for spamming or unsolicited communications
  • Conduct penetration testing without prior written authorization
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute access to the Service

3. Document Requirements

When uploading documents, you must ensure:

  • Documents are authentic and not forged or falsified
  • You have the right to upload and share the documents
  • Documents do not contain information you are prohibited from disclosing
  • Appropriate consents are obtained for documents containing personal data
  • Documents comply with your organization's policies and applicable regulations

4. Account Usage

  • Each user must have their own individual account
  • Account credentials must not be shared with others
  • You are responsible for all activities under your account
  • Report any unauthorized access immediately

5. Compliance

You must:

  • Comply with all applicable laws, regulations, and industry standards
  • Follow your organization's internal policies and procedures
  • Cooperate with regulatory audits and investigations
  • Maintain appropriate records as required by law

6. Audit Cooperation

You agree to cooperate with audits and compliance reviews conducted by Mercando, your organization, or regulatory authorities. This includes providing access to relevant information and responding to inquiries in a timely manner.

7. Reporting Violations

If you become aware of any violation of this policy, please report it immediately to:

Reports can be submitted anonymously. We take all reports seriously and will investigate promptly.

8. Enforcement

Violation of this policy may result in:

  • Warning: Written notice of the violation
  • Suspension: Temporary suspension of access
  • Termination: Permanent termination of access
  • Legal Action: Referral to law enforcement if appropriate

The severity of the response depends on the nature and impact of the violation. Serious violations may result in immediate termination without prior warning.
